The protection of your personal data is very important to us. Below we inform you to what extent and how your data is collected and used by Enginsight.

Personal data

Enginsight will collect and process your personal data in accordance with the applicable legal provisions, in particular, the Federal Data Protection Act (BDSG), and will always handle your data responsibly and carefully.

Your “personal data” is all information concerning your personal or factual circumstances. This includes all information that allows conclusions to be drawn about your identity (e.g. name, address, e-mail address, bank details, etc.).

Enginsight complies fully with applicable law when collecting, storing and using your personal data. In addition, Deutsche Startups undertakes to handle your data responsibly and carefully at all times.

Enginsight may also store non-personal data, such as the name of your Internet service provider or the page from which you visited Enginsight.

We use this data exclusively to improve our services, i.e. for statistical purposes. They are anonymous and do not allow any conclusions to be drawn about your person.

The use of cookies

In order to make your visit to the Enginsight website as attractive as possible and to enable you to use certain functions that considerably simplify the handling of our website for you, Enginsight uses so-called cookies.

Cookies are small text files that are stored on your computer. Many browsers are set to accept cookies automatically. You can change the settings of your browser at any time. However, a change may result in you not being able to use our website or not being able to use it to its full extent.

The Enginsight website also works with so-called session cookies and persistent cookies, without us always being able to specifically inform you of this in individual cases.

Web analytics services – Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. “This website is used on the basis of Art. 6 para. 1 sentence 1 lit. f. DSGVO. Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site.

The information generated by the cookie about your use of the website such as:

  • operating system used,
  • Referrer URL (the previously visited page),
  • Hostname of the accessing computer (IP address),

The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google. We have also added the code “anonymizeIP” to Google Analytics on this website. This guarantees the masking of your IP address so that all data is collected anonymously. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator. Newsletter

With the following information, we will inform you about the contents of our newsletter, as well as the registration, dispatch and statistical evaluation procedures, and your rights of objection.

Content of the newsletter

We send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter referred to as “newsletters”) only with the consent of the recipient or a legal permission. If within the scope of a registration for the newsletter, the contents of which are specifically described, they are decisive for the consent of the user. In addition, our newsletters contain information about our company (this may include in particular references to blog posts, lectures or trade fairs, our services or online appearances).

Double-Opt-In and logging

The registration to our newsletter takes place in a so-called Double-Opt-In procedure. This means that you will receive an e-mail after your registration in which you will be asked to confirm your registration. This confirmation is necessary so that nobody can register with external e-mail addresses.

The registrations for the newsletter are logged in order to be able to prove the registration process according to the legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address.

Likewise, the changes in your data stored with MailChimp are logged.

Use of the “MailChimp” mailing service

The newsletter is sent via “MailChimp”, a newsletter distribution platform of the US provider Rocket Science Group,LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The e-mail addresses of our newsletter recipients, as well as their other data described within the scope of this notice, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, MailChimp may use this information for its own information to optimize or improve its own services, e.g. for the technical optimization of the dispatch and display of the newsletter or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them or pass them on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and is therefore committed to complying with EU data protection regulations. In addition, we have concluded a data processing agreement with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with their data protection regulations and, in particular, not to pass it on to third parties. Credentials

In order to subscribe to the newsletter, it is sufficient for you to enter your e-mail address, optionally we ask you to enter your first and last name. This information is only used to personalize the newsletter.

Statistical data collection and analysis

The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. Within the scope of this retrieval, technical information such as information about the browser and your system, as well as your IP address and time of retrieval are first collected. This information is used to technically improve the services on the basis of the technical data or the target groups and their reading behavior on the basis of their retrieval locations (which can be determined with the help of the IP address) or access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our nor MailChimp’s aim to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our contents to them or to send different contents corresponding interests of our users.

Online access and data management

There are cases in which we direct the newsletter recipients to the websites of MailChimp. For example, our newsletters contain a link with which the newsletter recipients can retrieve the newsletters online (e.g. in case of display problems in the e-mail program). Furthermore, newsletter recipients can subsequently correct their data, such as the e-mail address. Likewise, the privacy policy of MailChimp is only available on their site. In this context, we pointed out that on the websites of MailChimp cookies are used and therefore personal data are processed by MailChimp, its partners and service providers (e.g. Google Analytics). We have no influence on this data collection. Further information can be found in MailChimp’s privacy policy. In addition, we draw your attention to the possibilities of objection to the data collection for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

Termination/revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. At the same time, your consent to its dispatch via MailChimp and the statistical analyses will expire. A separate revocation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible. You will find a link to cancel the newsletter at the end of each newsletter.

General Data Protection Regulation

In accordance with the provisions of the General Data Protection Regulation (GDPR), which came into force on 25 May 2018, we would like to inform you that your consent to the sending of e-mail addresses is based on Art. 6 Para. 1 lit. a, 7 GDPR and § 7 Para. 2 No. 3 or Para. 3 UWG. The use of the MailChimp shipping service provider, the performance of statistical surveys and analyses, and the logging of the registration procedure are carried out on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f GDPR. We would like to point out that you may object at any time to the future processing of your personal data in accordance with the legal requirements pursuant to Art. 21 GDPR, in particular against processing for the purposes of direct advertising.

As far as this is necessary for the fulfilment of the contract, data will also be transferred to our payment service provider or the credit institution commissioned with the payment processing. The scope of the data is limited to the necessary minimum for the purpose of contract processing.

In the case of payment by credit card, payment is processed via Stripe by the payment service provider Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland. Credit card information is stored by Stripe, not by Enginsight.

Use of artificial intelligence Enginsight NexT™

If you are using Enginsight KI to monitor your own metrics, please note the following:

The AI is explicitly designed for detecting anomalies in safety-critical time series data, such as CPU, RAM, etc. It is possible to include your own metrics, e.g. to find anomalies even during log-in attempts or production information, such as speed or similar. However, we strongly recommend not to use Enginsight NexT™ to monitor personal data, especially if the AI is to be used in any way to make automated decisions regarding this information. More detailed information can be found in Article 22 of the GDPR.

Disclosure of data to third parties

In certain cases, we are legally obliged to pass on your personal data to third parties (e.g. in the case of criminal prosecution).

The protection of your data

The Internet pages of Enginsight and the other systems are protected by technical and organizational measures against loss, destruction, access, alteration or distribution of the data by unauthorized persons. Despite regular checks, however, complete protection against all dangers is not possible.

Information deletion and blocking

You have the right at any time to free information about your stored personal data, their origin, and recipient and the purpose of data processing, as well as a right to correction, blocking or deletion of this data.
